Cross burning and the U.S. Supreme Court Ruling that Could Change State Laws
One of the most honored freedoms guaranteed by the Bill of Rights is the freedom of speech by the First Amendment. This right includes the right to engage in oral, written and symbolic speech. One type of symbolic speech that has typically not been protected by the states is cross burning. This paper examines the cases of R.A.V. v. St. Paul, State of Maryland v. Sheldon, and Virginia v. Black to determine the future of cross burning statutes and cases.
